These Terms of Service ("Terms") govern your access to and use of the NQ FUNDED website, evaluation programs and related services. By creating an account or purchasing an evaluation, you confirm that you have read, understood and accepted these Terms in full. If you do not agree, do not use the services.

By accessing this website or using any of the services, you agree to be bound by these Terms and any additional rules published for the evaluation programs. Services may only be used by persons of legal age in their jurisdiction who are legally permitted to enter into these Terms.
We may update these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.

NQ FUNDED is a proprietary trading firm that offers evaluation programs ("challenges") in which traders demonstrate trading performance under defined rules. Successful evaluation participants may, at the operator's discretion and after internal review, be granted access to a funded trading account under a separate agreement.
The evaluation is a performance-assessment service. It is not an offer of employment, investment management or investment advice, and nothing in these Terms constitutes financial advice.
IMPORTANT: All trading performed within the evaluation programs, and any trading on the funded accounts described here, takes place in a simulated trading environment. Orders are matched against simulated or third-party market data and are not executed on a live exchange unless explicitly stated otherwise in a separate written agreement.
Simulated accounts are not live brokerage accounts. Balances, equity figures, drawdown calculations and statistics shown in the dashboard reflect simulated performance, not real market positions. Where live-capital arrangements exist, their terms will be disclosed separately and in writing.
Evaluation account types and their objectives (for example profit targets, maximum drawdown, daily loss limits, consistency requirements and minimum trading days) are published on the website and in the account rules shown in your dashboard. The rules applicable to your account are those shown at the time of purchase.
Funded-account rules, including any funded-phase profit targets, consistency requirements or payout conditions, are displayed in your dashboard. Failure to comply with account rules may lead to the consequences described in section 9. Rules may differ between account types; you are responsible for reading and complying with the rules of your specific account.
Evaluation accounts are offered for a one-time fee, displayed on the pricing page before purchase. The fee is for participation in the evaluation program and is not a deposit, investment or balance transfer.
Payout eligibility, minimum payout amounts, profit split percentages, payout cycles and any minimum trading day requirements are published on the website and in the account rules. Payouts, if granted, are calculated from realized simulated profits as recorded in the platform's systems.
All payout requests are subject to an internal review of rule compliance. Violating any rules will result in a decline of your payout , evaluation.
Traders may not use, among other things: arbitrage exploits, data-feed latency abuse, "toxic" order flow directed against the simulated environment, copy-trading between accounts without permission, third-party signal services coordinated across accounts, hedging across accounts to game the evaluation, use of prohibited automated systems, or any activity prohibited by the published account rules.
We may monitor trading activity for compliance. What is considered prohibited is defined by the published rules for each account type; where this section and account rules differ, the account rules for your account prevail.
If an account exceeds a drawdown limit, violates a consistency requirement or otherwise breaches the applicable rules, the evaluation is deemed failed. Accounts found to be in breach, including through internal review, may be suspended, deactivated or terminated at the operator's discretion.
We may suspend or terminate access to the services, in whole or in part, for violation of these Terms, suspected fraud or abuse, or where required to protect the integrity of the platform. Where reasonably possible, we will inform you of the reason for the action taken.
Passed evaluations and payout requests may be subject to a manual review by the operator before approval. Review decisions are recorded and communicated to you through the platform. The operator's decision on evaluation completion, activation and payout requests is final unless an appeal is submitted.
If you disagree with a moderation decision, you may submit an appeal via the support contact in section 19 within. We aim to respond to appeals within a reasonable time frame.
You are responsible for the confidentiality of your login credentials and for all activity under your account. Accounts are personal and may not be shared, sold or transferred without prior written permission.
You must not attempt to gain unauthorized access to the platform, reverse engineer the service, interfere with other users, or use the service for any unlawful purpose. We may take technical and legal measures against abuse.
All content, trademarks, software and design of the website and platform are owned by the operator or its licensors and may not be copied, reproduced, distributed or used for commercial purposes without prior written consent.
You may use the website only for its intended purpose. Automated scraping, systematic data extraction and misuse of the website are not permitted.
The platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted availability. Market data may be delayed, inaccurate or unavailable, and simulated prices may deviate from live market prices.
Maintenance, technical interruptions, data-feed failures or third-party outages may affect trading. We are not liable for losses resulting from such interruptions, except where such liability cannot be excluded under applicable law.
To the maximum extent permitted by applicable law, the services are provided without warranties of any kind, express or implied, including fitness for a particular purpose. Trading involves substantial risk of loss; no statement on this website constitutes a promise of profit.
To the maximum extent permitted by law, the operator's aggregate liability arising from the services is limited to the fees actually paid by you for the affected evaluation account. Liability for intent, gross negligence, personal injury and statutory consumer rights remains unaffected where it cannot be excluded.
We process personal data as necessary to provide the services, for example account administration, payment processing and compliance reviews. Details of what data is processed, for which purposes and on which legal basis are described in the separate Privacy Policy.
The Privacy Policy forms part of these Terms.
The current version of these Terms, including its effective date, is published on this page. We may amend the Terms to reflect changes in the services, the law or our business. Material changes affecting your rights will be communicated in advance where reasonably possible.
The effective date of the current version is stated in the operator details section above.
